Terms of Service

TERMS OF SERVICE

Last Updated: October 25, 2026

1. Acceptance of These Terms

Welcome to dancestorsgenealogy.com (the “Website”), operated by Dancestors Genealogy, LLC (“Dancestors Genealogy,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the Website, including its contact forms, appointment requests, file-submission features and other Website functions.

By using the Website after receiving reasonable notice of these Terms, or by affirmatively accepting them when submitting a Website form, you agree to these Terms to the extent permitted by applicable law. If you do not agree, please do not use the Website. Contacting us by email, telephone, text message or a third-party referral service does not, by itself, establish acceptance of these Terms or create a client relationship.

If you hire us for genealogy research, a separate written service agreement will govern that engagement as described in Section 9.

2. Website Purpose

The Website is provided for general informational, educational and business inquiry purposes. It describes genealogy-related services and allows visitors to contact us, request information, schedule appointments, send us files and interact with Website content.

3. Informational Content and No Client Relationship

General information on the Website, including educational content, brochures and guides, is provided for informational purposes only. We strive to provide accurate and helpful information but do not guarantee that all general Website content is complete, current or error-free. Communications responding to an inquiry are not, by themselves, a commitment to undertake a research project.

Using the Website, contacting us, submitting information or attending an introductory appointment does not establish a client relationship, fiduciary relationship or other professional engagement. A paid genealogy engagement begins only when Dancestors Genealogy and the client enter into a separate written service agreement (see Section 9).

4. No Guarantee of Results

Genealogy and historical research involve interpretation, record availability and third-party source material that may be incomplete, inconsistent or unavailable. We cannot promise any particular ancestor, relationship, discovery, record, conclusion or research outcome. Any specific scope of work, deliverables or commitments for paid research will be set out in the applicable service agreement.

5. Permitted Use

You may use the Website only for lawful purposes. You agree not to:

  • Use the Website in violation of any applicable law or regulation.
  • Attempt to gain unauthorized access to the Website, server or related systems.
  • Interfere with Website security or functionality.
  • Submit false, misleading, abusive or unlawful content through our forms or other features.
  • Upload files containing viruses or harmful code, or materials you are not authorized to provide.
  • Copy, scrape, reproduce, republish or commercially exploit Website content without prior written permission, other than ordinary personal use or standard search-engine indexing.

6. Intellectual Property

Our original Website content, including text, graphics, logos, layout, design elements and materials created by Dancestors Genealogy, is owned by or licensed to us and protected by applicable intellectual property laws. The same applies to our original brochures, guides and other materials we provide, except for materials identified as belonging to third parties.

You may view, download and print such materials for personal, non-commercial use, provided you retain any notices and do not misrepresent ownership. Any other use requires our prior written permission.

You retain whatever rights you have in materials you submit to us. Submitting files or information grants us permission to receive, review, store and use them for responding to your inquiry and, if you become a client, as permitted by your service agreement and our Privacy Policy. Ownership and permitted use of deliverables produced under a paid engagement will be governed by that service agreement.

7. Third-Party Content, Links and Referral Services

The Website may contain links to third-party websites and integrate videos, reviews, podcasts, social media content, scheduling tools or other third-party features. We do not control their content, policies, availability or practices and are not responsible for them to the extent permitted by law. Your use of third-party services is subject to their own terms and policies.

If you contacted us through a third-party lead or referral service, that service operates independently and its terms govern your use of its platform. Dancestors Genealogy does not operate or control those services.

8. Appointments, Inquiries and Quotes

Submitting a contact form, booking request, appointment request or uploaded file does not guarantee acceptance of a project or availability of services. We may decline inquiries, reschedule appointments or refuse service where appropriate and lawful.

Any preliminary quote, price range or estimate is informational and does not become a binding project price or commitment until included in a written service agreement accepted by both parties.

9. Research Services and Service Agreements

If you hire us, the scope of work, fees, payment terms, deliverables, handling of research information and any other project-specific conditions will be governed by a separate written service agreement, which may be signed electronically. If that agreement conflicts with these Terms, the signed service agreement controls with respect to the paid engagement.

These Website Terms do not replace or modify an existing signed service agreement.

10. Communications

If you provide contact information, we may use it to respond to your inquiry, follow up on requested services, communicate about appointments and projects, and send other communications consistent with our Privacy Policy.

  • Calls and texts. If you provide a phone number, we may call or send individually written text messages relating to your inquiry, appointment or project. We do not use automated or mass marketing texts. Standard carrier message and data rates may apply. You can ask us to stop nonessential calls or texts at any time.
  • Email. You may receive individual emails concerning your inquiry or services. You can ask us to stop nonessential emails, although we may still send communications reasonably needed to fulfill requested services or legal obligations.
  • Newsletter. Individuals who contact us, including through our Website contact form, or who use our services may receive our newsletter or occasional business updates. Marketing emails include an unsubscribe option. Unsubscribing does not stop necessary communications about an inquiry or active project.

Our Privacy Policy explains how we handle contact details, communications and marketing preferences. Where applicable law requires separate consent for a type of communication, we will obtain it.

11. Files and Information You Send Us

You are responsible for ensuring that, to the best of your knowledge, you have the right or other lawful basis to provide the photos, records, family trees, DNA information, account-access permissions and other materials you submit. Please exercise particular care with information concerning living individuals. We may ask for documentation of authority or separate written permission before accessing DNA accounts, uploading genetic information to another service or contacting DNA matches.

Please provide copies rather than irreplaceable originals and retain your own backups. Do not send passwords, payment-card details or other highly sensitive credentials through general Website forms or ordinary email.

We handle submitted materials as described in our Privacy Policy. If you hire us, your signed service agreement also governs their use in your research project.

12. Disclaimer of Website Warranties

The Website and its general informational content are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Dancestors Genealogy disclaims warranties, express or implied, concerning the Website, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not guarantee uninterrupted availability, error-free operation or that the Website is free from viruses or other harmful components. This Section concerns the Website and does not override express commitments in a signed service agreement or rights that cannot lawfully be disclaimed.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Dancestors Genealogy, LLC and its owners, officers, employees, contractors and affiliates shall not be liable for indirect, incidental, consequential, special, exemplary or punitive damages arising from use of, inability to use, or reliance upon the Website or its general informational content.

Nothing in these Terms limits liability that cannot lawfully be excluded or restricted.

These limitations apply only to the Website and its general informational content. Any liability arising from paid genealogy research services shall be governed by the applicable signed service agreement.

14. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Dancestors Genealogy, LLC and its owners, officers, employees, contractors and affiliates against third-party claims, damages, liabilities and reasonable costs, including attorneys’ fees, to the extent resulting from your unlawful misuse of the Website, intentional violation of these Terms or submission of materials you had no lawful right to provide. This provision does not require you to indemnify us for our own negligence or wrongful conduct.

15. Geographic Restriction

The Website is intended only for users located in the United States. We may use technical measures, including geolocation-based security tools, to restrict access from outside the United States. These measures may not prevent every instance of access from outside the United States.

16. Changes to These Terms

We may revise these Terms by posting an updated version on this page and changing the “Last Updated” date. The revised Terms will apply to subsequent use of the Website to the extent permitted by law. Changes to Website Terms do not amend an existing signed service agreement unless the parties separately agree to an amendment.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise. To the extent permitted by law, disputes arising from these Website Terms will be brought in the state courts located in Denton County, Texas, or, if federal jurisdiction exists, in the United States District Court for the Eastern District of Texas, Sherman Division. Any different dispute-resolution terms in a signed service agreement will control disputes arising under that agreement.
